General Contracting Conditions

1 Object

These General Contracting Conditions (hereinafter «CGC») govern the relationship of the user (hereinafter «the user») with GRUPO IJOINT 2018 SL (hereinafter, «IJOINT»), company with CIF B93607174 and registered office in c / Ollerías, n. 18, CP 29012, Málaga. The reading of these CGC is a necessary and essential condition for the formalization of the purchase of any item or product through the site


The CGCs allow the user to be aware of some important characteristics of the service provided by IJOINT, such as customer service and delivery service that IJOINT provides directly or indirectly (hereinafter, collectively, «the service»).


Completion of the forms made available to the user to place an order, as well as the provision of bank details, credit card or any other means of payment accepted by the website, implies full and unreserved acceptance of each and every one of the provisions included in these GTC.




2 Registration and purchase process

Access and consultation of the product catalog of the site is free , and users do not have to register. To make the purchase and purchase the products published on the website, the user must register as such, as long as they comply with the essential requirement of being over eighteen (18) years of age, and provide, through the form arranged, all the data required and identified as mandatory. The user account is personal and non-transferable, both individuals and legal entities can register on the website. The user will have an access password that will be personal and non-transferable. The user may modify or recover said password at any time, following the procedure provided on the website.


It is the user’s obligation to immediately notify IJOINT of any fact that allows the improper use of the identification and / or password (theft, loss or unauthorized access) to them, in order to proceed with their immediate cancellation. As long as such facts are not communicated in a reliable manner, and the receipt of the communication to IJOINT is recorded, the provider will be exempt from any responsibility that may arise from the improper use of the identification and / or password by unauthorized person.


The purchase process consists of the following phases:


1 Shopping basket validation: once the user has selected the products they wish to purchase, they must access their shopping basket, in which the selected products, price, term and shipping costs will appear, supervising that the data is correct and proceeding to give its agreement by accepting and validating the purchase.

2 Provision of billing and shipping data: the user must provide IJOINT with the billing and shipping data for the products, and must expressly accept, by checking the corresponding box, the contribution of these data.


3 Selection of payment method: the user must then select the payment method to use. Currently IJOINT allows as payment methods: debit or credit card and PayPal.


4 Payment of the purchase: the user will be automatically redirected by the system to the online payment platform of the corresponding banking entities. At this point, IJOINT will no longer be responsible for the payment and the system chosen for it, therefore the entity issuing the card or payment system chosen is responsible for the security of the transmission.


5 Confirmation of the purchase: IJOINT will send the user, within a maximum period of 24 hours from the moment of the actual payment of the purchase, an email containing a summary with all the details of the purchase made.


The user, by accepting these conditions, agrees to receive the invoice in electronic format derived from the purchase of IJOINT products. In any case, the user can consult and download the invoice in the My Orders website area. The order confirmation and the proof of purchase will not be valid as an invoice.


Once all the required data has been provided and the purchase is processed and confirmed, the contract will be understood to be perfected for all purposes. Once the contract is perfected, the purchase cannot be canceled except in the cases expressly provided for in these GTC or in the law. Likewise, once the confirmation takes place, if the user wishes to modify the data that he had provided during the process, he must contact IJOINT through any of the means provided.


The delivery of the object of the purchase will be made in accordance with the provisions of these CGC.




3 Offer validity period

The prices and conditions displayed on the website are valid for as long as they remain accessible to users, and are valid only in the open session. IJOINT is not responsible for any changes that may exist between sessions.


4 Prices, billing and payments

The prices indicated on the website are referred to in euros and always include indirect taxes. The corresponding prices and charges specified in the article description will be applied to the different articles in accordance with the rates and other general and / or particular conditions, offers or economic promotions in force, if any, and which will be published on the IJOINT website. or in other media such as social networks


Shipping costs are not included in the item description and will be detailed at the end of the purchase process. These expenses will be the responsibility of the user in its entirety unless expressly stated otherwise. Freight will be detailed on the invoice.


In order to carry out the bank card transaction, the information provided on it and its holder must be correct. No charge will be made and, therefore, the purchase will not be carried out, if the details of the bank card are not correct.


In the event that the data of the buyer and the holder of the bank card do not correspond, IJOINT reserves the right to contact the buyer to confirm his identity or to contact the bank to ensure that  there are  no notifications of bank card theft.


Charges will be made to the bank card at the time the purchase details are confirmed. In the event that the charge could not be made for any circumstance, IJOINT will contact the user to inform them of the incident.



Payment by card will not accrue additional expenses. These payments are made through a secure server in order to protect your data at all times. However, any data transfer over the internet has the risk of being intercepted in violation of security systems. IJOINT is not responsible in the event of such a circumstance.



5 Obligations of the parties

Without prejudice to the provisions of the remaining conditions of these CGC, IJOINT will be obliged to:


1 Provide complete information on each item for sale displayed on its website.

2 Take the necessary actions to enable the sale of items through the web to proceed correctly and without incident.

3 Have an after-sales service and customer service available to buyers.

4 Have the necessary means and provide the service so as to ensure that the buyer receives the purchased item in the best conditions.

For its part, the user’s obligations will be as follows:


1 Use the service in accordance with the Website Conditions of Use, the Privacy Policy and these General Contracting Conditions.

3 Do not use the website and the service offered by IJOINT against the requirements of good faith or use the website improperly, illicitly, maliciously or fraudulently.

4 The user will be solely responsible for the veracity of their personal data and undertakes to provide authentic and truthful data. Any variation or modification of your personal data that may be relevant to the proper provision of the service must be notified without delay to IJOINT.

5 The use of the service to minors is not allowed.



6 Delivery of orders and deadlines

IJOINT will provide its services in general to the entire Spanish national territory. The delivery of the products will be made to the home address by certified mail. The user may, through the website of the transport operator, track their order, receiving an SMS or email with the status of the order and its delivery date. The transport operator will contact the user to proceed with the delivery.


IJOINT will send the requested products according to the data provided when placing the order, and will not assume any responsibility for impossibility of delivery in the event that the data provided is inaccurate or incomplete. Likewise, it does not assume responsibility when the delivery cannot be made due to the absence of the recipient, or due to the physical impossibility of making the delivery. If delivery is not possible for the above reasons, IJOINT will cancel the contract due to impossibility of performance, without prejudice to the claims that it may initiate against the buyer if there is fraud or fault of the latter. Likewise, the costs of the failed shipment and its subsequent return will be the responsibility of the user.


If, once the purchase has been confirmed, the user wishes to modify the delivery data that they  provided during the process, they should contact IJOINT through any of the means provided by the customer service. If the order has already been shipped, the user must bear the cost of a new shipment.


The estimated delivery time for each product will be two to five business days. However, this period may vary depending on the availability of the product, the destination or due to circumstances beyond IJOINT, for which it is not responsible.


In the event that at the time of receiving the order it shows visible signs of deterioration or of having been opened, check its content before signing your agreement with the reception. If the order is damaged or incomplete, return the order and contact us through any of the means provided so that we can send you a new shipment



7 Availability

Orders are subject to the availability of the products. In the event that the shipping confirmation is sent, IJOINT will not be able to dispose of the requested product due to any circumstance, IJOINT will contact the user as soon as possible, offering:


– A product with similar characteristics to the one originally requested.


– Cancellation of the requested order, refunding the amount paid within 30 days.



8 Right of resolution and withdrawal

Payment must be made by any of the means indicated in the CGC. The lack of payment as well as the fraudulent use of the credit card or the denial of the collection operation, will entitle IJOINT not to process or deliver the order, without prejudice to demanding compensation for the damages and losses produced.


The buyer may withdraw from the contract within thirty (30) calendar days from when the user or a third party indicated by him acquires material possession of the items requested through the web form attached to the return request or by communicating it to our email address through an unequivocal statement indicating your intention to withdraw from the contract, identifying the order by its number and providing the email that appears in the operation. This right may be exercised on one, several, or all of the articles received. Once the term of thirty (30) calendar days has ended, IJOINT will not accept returns for withdrawal of purchase of products.


The exercise of the right of withdrawal is conditioned by the following requirements:


– That the articles and their packaging are in perfect condition.


– That your return is accompanied by supporting documents of the transaction (copy of the proof of purchase and the delivery note of the products in the package).


– The return will include the amount of the purchase and, if any, the delivery costs. The return will be made in the same means of payment by which the product was purchased, discounting the return costs that will be the responsibility of the user.


– That the buyer bears the return costs and sends them properly protected for transport. In this sense, it will be responsible for the damages that the product may suffer during its transportation to our facilities.


IJOINT undertakes to reimburse any payment received from the buyer within fourteen (14) calendar days from when it is aware of the buyer’s exercise of the right of withdrawal. Likewise, IJOINT reserves the right to withhold the refund until the items have been returned.


In the case of orders that contain more than one product, or multiple orders, IJOINT will only assume the costs of returning or changing one of the products.



9 Processing of personal data

All the information provided during the purchase process will be stored by IJOINT as the person responsible and in charge of the data processing provided on the website during the registration and purchase process.


The purpose of said treatment is the maintenance of the commercial relationship and the services offered and contracted for in this relationship. The legitimate basis for this treatment is the commercial obligation itself. The personal data of the user will be kept during the validity of the commercial relationship and afterwards, taking into account the legal terms that are applicable in each specific case, considering the type of data, as well as the purpose of the treatment, provided that the user does not   exercise the right of withdrawal.


IJOINT guarantees the holder the exercise of the rights of access, rectification, deletion, opposition, limitation and portability by writing and accompanying a photocopy of identity document to the address


The data provided by the user will be made available to the transport and logistics company responsible for carrying out the delivery of the item purchased through the website, the entity in charge of the financing indicated in these conditions, as well as any other operator involved in the purchase, financing and delivery process, for the purposes of fulfilling the contract with the user. In any case, before communicating the user’s personal data to third parties, the user must have expressly  accepted it beforehand.



10 Customer service and notifications

For any claim or information related to the operation of the website, billing, quality or any other issue related to the provision of the service, there will be a customer service service  which the user should contact as soon as he is aware of the reason for his/her claim.

The same contact method may be used for any communication or notification that the user wants to send regarding the service and its execution.


Complaints and claims submitted by users will be assigned a reference number and a receipt will be sent to the email address used by them in their communication. In the event that the claim is made by telephone, the user may request a document that certifies the presentation and its content. Said document will be sent within ten (10) days of your request.


When the claim has been resolved, IJOINT will use all means at its disposal to inform the user of the solution adopted through the same means used to file the claim.


11 Modification of the CGC

IJOINT may make modifications, at any time and without prior notice, to these GTC, notifying the user at least one (1) month in advance of its entry .


Said modifications will be made by any form admissible in Law through this web page and will be binding as long as they are published and have not been modified by other subsequent ones. The modifications made will not affect in any case the purchases that have been made prior to the approval of the modifications.


11 Nullity

The declaration of nullity, ineffectiveness or invalidity of any of these CGC, will not affect the validity of the remaining conditions, which will remain in force and will be binding for the parties.


The non-exercise by IJOINT of any of the rights expressed in these CGC shall not be interpreted as a waiver of said right.




13 Applicable law and jurisdiction

The legislation applicable to the relationship that unites the parties is Spanish and is subject, with the exclusion of any other forum that may correspond to it, to the jurisdiction of the Courts and Tribunals of Malaga, for the resolution of differences arising from the interpretation or application of these terms and conditions. In the event that the user has the status of consumer, the competent forum will be the one that determines in each case the regulations on consumer and user protection.
